PERFORM TERMS OF SERVICE

The Perform program was created by Perform Inc. This is a performance enhancement program for individuals seeking to improve their physical and mental performance. The program has been proven to be very effective in helping people attain long term improvement when users are full partners in the process and the rules and standards of the program are strictly adhered to.

The program has four basic parts:

  1. Expert guidance from professionals with individuals seeking performance improvements. This guidance is followed by training sessions and/or coursework that focus on performance enhancement as well as other topics relevant to continued improvement in all areas of performance.
  2. Individual customization includes meeting with a performance coach one-on-one or participating in online coursework sessions that focus on the topics of performance enhancement, goal setting, and other performance improvement measures.
  3. Personalized recommendations are provided with only sufficient guidance to last until the next sessions with the performance coach.
  4. Agreement to adhere to all program rules including following recommendations, submitting to performance testing, both scheduled as well as random, not misusing the program, and observing confidentiality of all other users' participation in the program.

To participate in the Perform program:

People are eligible for participation in the Perform program if they are referred to the program by their coach, friend, family member, or other health or performance provider.

Prospective users will have an initial session with our staff to verify performance goals are met as well as to provide other program staff with the user's performance history and to ascertain the user's reason(s) for seeking enhancement at the present time and to determine whether the program is appropriate for the user.

Purpose and goals of treatment:

  1. I understand that the long-term goal of this program is to improve performance and to build a foundation of excellence that allows me to completely change my capabilities.
  2. I will follow all recommendations; including nutrition, training, and recovery recommendations. I understand that failing to follow recommendations may result in the treatment team referring me to a different program or discontinuing my participation in the Perform program.

Program Requirements:

  1. I will attend the training as required and scheduled. I understand the Perform Program consists of Performance Management Appointments, Group Training Appointments, and Individual Coaching Appointments as required by the program. Attendance is required for each appointment unless I have notified the treatment team in advance of my need to miss an appointment and I am eligible for a makeup appointment.
  2. I understand that the treatment team may require that I attend meetings each week. Failing to follow through on my meeting attendance may result in termination of my treatment in the program.
  3. I understand that I will be asked about my performance history as well as other relevant tests as required by the treatment team.

Attendance:

  1. I will keep and be on time for all my scheduled appointments.
  2. If an emergency arises, I will call the call center to inform the office at (555) 123-4567 or email support@perform.com. I must call to cancel at least two hours before my scheduled appointment.
  3. I understand that a canceled appointment may result in my not being able to get my coaching/prescription until the next scheduled visit.
  4. I understand that an unexcused missed appointment or "no showing" an appointment may result in my being terminated / suspended or referred out of the program.
  5. Cancellations 2 weeks in a row may result in termination from the program. If terminated from the program for any reason, I must wait 30 days to reapply for participation or longer depending on the waiting list. Readmission to the Perform program is always at the discretion of the Perform Team.

Payment:

  1. If there is a co-payment or charge I will pay my fee on the day of the service. Failure to pay for services, without prior payment arrangements, may result in suspension or termination from the program.

Use of Services:

  1. I will take my training as my coach has instructed and not to alter the programming or the way I train.
  2. I will not sell, share, trade, or give away any of my personalized programming or any other prescription. I understand that such mishandling of my program is a serious violation of this agreement and will result in my participation being terminated without any recourse for appeal.
  3. I understand training programs contain proprietary information that can be a target for people who abuse such information. I understand that the information I receive is my responsibility and that I agree to keep it in a safe, secure place and protect it from theft. I understand that replacement programs for lost or stolen information will likely not be provided.

Conduct in Program:

  1. I will conduct myself in a courteous manner and not engage in any illegal or disruptive activities in the program or facility property. If I do not adhere I put myself at risk of being discharged.
  2. I will provide my own data for random performance tests as requested. Random performance tests will be observed. I understand that I have 30 minutes from my scheduled arrival time to provide test data. I understand that tampering with, buying, selling, or otherwise procuring false data will result in my immediate termination from the program as it is an admission of poor performance.
  3. I understand bringing any children to my appointments is prohibited. It is my responsibility to find arrangements for my children to be watched while in my appointments. If this becomes an issue that results in my missing my appointments, I understand it may result in my discharge from the program.

Confidentiality:

  1. I understand that those I see and what I hear in training is strictly confidential. Violation of confidentiality will likely result in immediate discharge and may subject me to other penalties and sanctions as prescribed by laws and regulations governing the protection of individual confidential information.
  2. Confidentiality extends to all forms of social media. Any posting on Facebook, Twitter or any other social media about any participation in the Perform program is strictly forbidden and any mention of any other user or participant of the Perform program is a blatant violation of user confidentiality and will result in immediate discharge may subject me to other penalties and sanctions as prescribed by laws and regulations governing the protection of individual confidential information.

I have read and understand the above agreement and my questions have been addressed. I received a copy of this agreement.
